# US finalises order over an AI ad service that used smart device conversations

**Background**

On 26 August 2026 the FTC finalised its order against CMG Media over an AI-powered advertising service that reportedly targeted consumers using conversations captured from smart devices. Three related settlements totalled $930,000.

**Three key points**

**1\. The AI targeting claim was the problem.** The service reportedly targeted consumers based on conversations believed to have been captured from smart devices, with supposed consumer opt-in. The FTC found that claims about consent and the basis for targeting were deceptive. The case uses the agency's existing power over deceptive practices to reach AI-specific conduct.

**2\. AI capability claims are under scrutiny.** The action against CMG Media fits a wider pattern of enforcement against companies making inflated claims about what their AI systems can do. The FTC has separately proposed a policy statement addressing suppression of the accuracy of AI systems, which affects how marketing claims about AI products are substantiated.

**3\. Substantiation is the standard.** The FTC applies its existing requirement that advertising claims be substantiated to claims about AI capabilities. That standard does not lower because the product is AI-based. The technical complexity of AI can make overclaiming easier, which makes the enforcement risk higher.

**Why this matters**

Advertisers and technology vendors selling AI capabilities need to ensure that claims made in their marketing are accurate and substantiated. Consent frameworks for data used in AI-based targeting must be documented and defensible, not just assumed.
